Terms and Conditions
1. Sessions Fees
The session fee covers the photographer’s time and talent and is due at the time of booking. Session fees taken for any portrait photography session are non-refundable except in the event that Vita Vestra Photography cancels the booking. The client may cancel a session at any time but in doing so shall forfeit any monies paid. A session may be rescheduled with no loss of fee if notified to Vita Vestra Photography via telephone or email 48 prior to the session. For customer loyalty a 50% discount is applied for customers who have booked two previous sessions. The price for the 3rd and subsequent sessions will be charged at 50%
2. Price of products
Upon booking a session with Vita Vestra Photography please make sure you have fully viewed the price list. It is presumed every Client has read the price list. You can view a copy HERE.
3. Fulfillment of obligations
Vita Vestra Photography shall not be liable to the Client for any failure, in whole or in part, to fulfill their obligations where failure arises as a result of an event or circumstances beyond their control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the Photographic coverage will be as Vita Vestra Photography’s’ professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Clients wishes. In the unlikely event of total photographic failure or cancellation of the contract by Vita Vestra Photography, liability shall be limited to a full refund of all monies paid.
4. Gallery & 1-2-1 Viewing
In booking a Vita Vestra Photography session the Client agrees that viewing images for Lifestyle sessions are targeted to be delivered within 2 weeks of the session, however this is not a contractual time and the images will be ready when the full editing process has taken place. The Client will have 7 days to view their Gallery, after the session, and to make their selection and download the images. All orders and payment in full is due at this time. All portrait orders are final and cannot be changed or refunded for any reason once print orders have been made by the photographer or the Client is in receipt of the images.
There is no guarantee that any particular number of images will be produced from your session. Vita Vestra Photography is not obligated to provide the client with any images that are not already presented to them in the Gallery.
5. Artistic input
Vita Vestra Photography shall be entitled to use their judgment regarding the style and artistic input in the production of pictures. This includes but is not limited to poses, props and number of images taken. Due the willingness of subjects it may not be possible to capture all the pictures requested, or images to the clients full expectations. In the event of uncooperative children at a session of any kind, for any reason, Vita Vestra Photography may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.
Images are fully edited before presenting to Client. Additional edits are carried out at the discretion of Vita Vestra Photography. Vita Vestra Photography reserves the right to charge the Client for additional editing to cover time involved.
6. Copyright and reproduction
Copyright is retained by Vita Vestra Photography at all times throughout the world. No image can be copied, scanned or reproduced in any form whatsoever without prior consent of Vita Vestra Photography. The Client may not alter, add to or manipulate a picture by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without Vita Vestra Photography’s written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Vita Vestra Photography only when digital images are purchased and paid for in full by the client to Vita Vestra Photography.
7. Use of pictures
Vita Vestra Photography will use Clients images for the purposes of display, advertising, portfolio, publication or promotion online and offline unless Clients expressly decline in writing, this is presented in a contract with key terms prior to booking. To 'opt-out' the Client must specify which elements they do not agree to. This will be updated on your contract prior to your session.
8. Receipt of portraits, wall art or products
All orders are presumed to have been received in good condition unless the Client notifies Vita Vestra Photography in writing of any discrepancy or error within 7 days of receipt.
9. Cooling off period
All portraits, books, albums, frames, etc are non refundable. Orders are made to the Clients personal specification, (i.e. image number, print size, frame style etc), the Client does not have the right to a cooling off period. By placing an order with Vita Vestra Photography you are committing to buy the ordered products.
10. Returns policy
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.
11. Deleted images
All non-purchased images are archived for 48 months after your session (5 years for weddings). A £25 retrieval fee is charged to re upload any archived Gallery.
12. Cameras, mobile phone cameras and camcorders are NOT permitted during any session, in Studio or location without express permission from Vita Vestra Photography. Images posted online using Vita Vestra Photography props will be subject to a hiring fee of equipment used of £65 per image.
